Contact with a child in Russia: foreign parent, guardian, enforcement

Direct answer. Living outside the Russian Federation does not cancel parental responsibility. A Russian district court may set a contact regime — calls, video and in-person time — even where a relative has been appointed guardian after the other parent’s death. Enforcement is a separate file: the Federal Bailiff Service (FSSP) and article 5.35 of the Code of Administrative Offences, not another round of private messages.
What the foreign parent still holds
Articles 61 and 66 of the Russian Family Code treat parents as equals. Contact, upbringing and schooling remain rights of the parent who does not live with the child, unless a court has restricted or terminated those rights. Foreign nationality of the parent or of the child does not, by itself, remove the Russian court’s jurisdiction while the child is in Russia.
Guardianship of a maternal or paternal relative is not a silent termination of the surviving parent’s status. The guardian must not obstruct contact once a court has defined it. A U.S., EU or other “do not travel” advisory is a fact for the format of contact. It is not a licence to ignore a Russian order, and it is not, without more, a ground for the court to cancel in-person time.
Two tracks to a workable timetable

Article 203 of the Civil Procedure Code varies the manner and method of executing an order that already exists. Use it to move a 19:00 Moscow call window to 16:00 or earlier, and to name a video service. Timing is measured in weeks to a few months.
A fresh claim under article 66 of the Family Code is the proper vehicle if the court must drop the guardian’s presence at visits or replace fortnightly Saturdays with compensatory stays of two or three weeks. International files of that kind often run four to eight months, longer if a psychological assessment is ordered.
Making the order bite
After the act takes effect the parent applies for a writ of execution and opens enforcement at the FSSP unit for the child’s district. A parent’s own screenshots rarely become a bailiff’s record. A Russian notary or a certified capture system, timed to the court’s window, is what turns a missed call into an official act.
Article 17.15 CAO RF (failure to obey the bailiff) is a weak lever. The working offence for blocking contact is article 5.35(2); a repeat finding under 5.35(3) can carry administrative arrest. Complaints to the guardianship authority and, if that authority is inert, to the prosecutor sit alongside the FSSP file. Removal of a guardian is article 39 of the Civil Code, on proof that duties are not being performed.
Taking the child out of Russia

Consent of the legal representative, a court permission for a defined trip, and a change of legal representative are three mechanisms. There is no single “exit claim” with a high base-rate of success while the guardian remains cost-free. Documented non-compliance is what makes a negotiated or court-approved departure discussable. Recognition of a Russian act in Turkey or in an EU State is a second file and should be scoped separately.
Power of attorney and remote filing
A notarised power of attorney, apostilled or consularly legalised in the country of execution, plus a sworn Russian translation, allows electronic filing through the advocate’s cabinet. Special powers must cover all courts, receipt of writs and certified copies, FSSP (including settlement of enforcement), the guardianship authority, and receipt of documents and funds.
FAQ
Can I run the case without entering Russia?Filings and most hearings can proceed through counsel. The court may still want the parent at a particular sitting. That is a case-management issue, not a condition of standing.
Will the Hague 1980 Child Abduction Convention decide contact? The 1980 Convention is about wrongful removal or retention and return, not about designing a weekly call roster. Contact after a child is settled in Russia is primarily a Russian Family Code problem.
Should death threats be reported at once?A complaint under article 119 of the Criminal Code can be filed through counsel from abroad. It may support a request to keep the guardian out of visits. It may also harden a “child safety” narrative. That choice is a written risk decision, not an automatic first step.
Do you accept AI-prepared chronologies?Yes, as working papers — timelines, exhibit lists, draft translations, call logs — after advocate verification. Unedited machine pleadings are not filed.
